Slip and Fall is a generic term
for an injury that occurs when someone slips, trips
or falls due to a hazard on someone else's property.
These hazards may include situations like ice, snow,
or water resulting in slick or uneven footing as
well as objects in the walkway (boxes, toys, cables)
or conditions (poor lighting) that result in a trip.
Though not technically a "slip
and fall" situation, we also include injuries
resulting from other hazardous conditions on the
property such as low hanging signs or branches and
falling items such as from the top of a closet or
store shelf.
People who suffer an injury often
do not report it because they blame themselves, are
embarrassed, or do not believe the injury is
serious. Any injury, regardless of how slight,
that occurs on someone else's property should be
reported to the property owner immediately. On
commercial properties don't hesitate to ask for a
written accident report and make sure it includes
any conditions that contributed to the accident. In
other situations make a note to yourself of these
circumstances.

Don't dismiss the injury because it is insignificant.
Scrapes and minor cuts can become infected. Muscle
strains and sprains may present themselves as a little
soreness or tenderness until the swelling sets in.
In the event of a serious injury, seek medical attention
immediately. Stores, restaurants, and other commercial
venues should provide an ambulance at your request.
In the event of an injury where the property owner is at
fault, payment of the resulting medical bills may be the
least of the owner legal responsibilities. They may also
be responsible for lost pay, reimbursement for pain and
suffering, and in some situations punitive damages.
Not every accident has to result in a law suit. Many
property owners are reasonable and will make every
effort to meet their responsibilities. It is often,
however, in your best interest to consult an attorney in
order to fully understand what you are entitled to and
to negotiate any disagreements on your behalf. |
